DMCA Policy
Storms Leave Texas ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Storms Leave Texas website and/or any other online services that are reported to our Designated Copyright Agent identified in the sample notice below.
This policy describes the information that should be present in a DMCA Notice and Counter-Notification and how Storms Leave Texas will handle such notices.
Filing a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Storms Leave Texas website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Storms Leave Texas will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the website.
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work, e.g., a link to the original work or a copy of the work. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
- Identification of the material that is claimed to be infringing: Provide sufficient detail to allow us to locate the material, e.g., a link to the specific page or content on the Storms Leave Texas website that you claim infringes your copyright.
- Contact Information of the Complaining Party: Include your full legal name, mailing address, telephone number, and email address.
- A statement that the complaining party has a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- An electronic or physical signature of the complaining party: The signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent. Upon receipt of a Counter-Notification as described below, we may, in our sole discretion, restore the removed content within 10-14 business days unless the copyright owner files an action seeking a court order against the content provider, member, or user.
- Identification of the material that has been removed or to which access has been disabled: Identify the material and its location before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The subscriber's name, address, and telephone number: Your full legal name, mailing address, and telephone number.
- A statement that the subscriber consents to the jurisdiction of the Federal District Court: A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which Storms Leave Texas may be found, and that the subscriber will accept service of process from the person who provided the DMCA notification or an agent of such person.
- The subscriber's electronic or physical signature: Your electronic or physical signature.
